2010年春节，对甘肃天水农民李建平来说，过得有几分忐忑。春节前，他向甘肃省兰州市中级人民法院递交了一份诉状，将甘肃省、天水市、清水县三级疾控中心告上法庭，请求法院判令三被告赔偿各项经济损失310万元。
这个案子不久后将公开审理，李建平不知道他会拿到一个什么样的结果。他也不清楚，就算官司赢了，村里人是不是还会以为他是“艾滋病患者”。
2003年10月，李建平被当地疾控中心工作人员宣布得了艾滋病；4年后的2007年10月，甘肃省、天水市、清水县三级疾控中心领导专程赶到李建平家里，宣布他已经痊愈了。
从“被艾滋”到“被痊愈”，李建平在经历了人生中的大悲大喜之后，开始奔波于三级疾控中心，他想弄清楚一个问题：我的艾滋病是怎么得的又是怎么好的但他至今没有得到答案。
“被艾滋”
今年44岁的李建平是甘肃省天水市清水县金集镇瓦寨村村民。他在诉状中称，2003年，瓦寨村一位村民李某因病被送往医院救治，在医治无效死亡后被确认为患有艾滋病。
在这位村民住院期间，李建平作为病人的邻居，曾在医院陪护过几天。2003年8月，金集镇卫生所对瓦寨村近百名群众进行了采集血液样本检验。因死者李某是李建平的邻居，且陪护过李某，因此李建平参加了这次集中血液采样。

随后，清水县疾控中心、金集镇卫生院和镇派出所到天水市麦积区，将在此打工的李建平妻子张某带回金集镇卫生院强行采集血液样本进行检测。尽管张某的检测报告为阴性，但也被告知“不得外出”，和李建平一样要接受血液样本季度检测和跟踪服务。
李建平在诉状中还称，他的两个孩子正在上课时，也被带到卫生院强行采集血液样本进行检测，检测报告仍然为阴性。
虽然李建平的妻子、两个孩子的血液样本检测都呈阴性，但瓦寨村的很多村民都认为李建平一家四口都是艾滋病患者，人见人防，两个孩子因无法忍受歧视而辍学。
“被痊愈”

自打李建平被宣布是艾滋病患者后，他就一直在镇卫生院接受每季度的采集血液样本的检测和跟踪服务。在每次采集血液之后，李建平都会向清水县疾控中心的张建国主任咨询病情，每次都被告知“CD值的指数很高，好着呢”。

当时，李建平就对疾控中心的检测有所怀疑。几天后，村里另外一个李建平被通知去采集血液样本检测，但结果是阴性正常。
此后，李建平多次向清水县疾控中心主任张建国打电话和当面咨询病情，都被告知CD值的指数很高，情况很好。
2007年，清水县疾控中心在每季度的采集血液样本检测中没有通知李建平参加。而在2003年至2007年的4年间，李建平的身体一直都很正常，没有任何异常反应。
综合这些因素，李建平开始对自己是否患有艾滋病产生怀疑。他继续向清水县疾控中心询问，但都没有任何回应。
2007年10月13日，李建平到天水市疾控中心自费采集血液样本检测。天水市疾控中心主任刘宝录答复他，CD值指数在800以上，艾滋病病毒几乎为零。

经过一番考虑后，李建平携妻儿共4人作为原告，将甘肃省疾控中心、天水市疾控中心、清水县疾控中心告上法庭，要求判令三被告立即停止侵害，消除影响，恢复名誉，并在省级报刊和电视上公开道歉；同时，要求判令三被告赔偿原告各项经济损失310万元。
有知情人士透露，当地疾控部门早在2006年就已经知道李建平没有患艾滋病。那么，疾控部门为什么没有及时告知这一消息后来宣布李建平“痊愈”之后，为什么没有给一个合理的说法呢
当地一位不愿透露姓名的专家认为，李建平“被艾滋”的背后，反映了疾病检测与认定的管理混乱、缺乏监督，院方与“病人”二者之间权利的严重失衡。此事中，如果疾控部门能够勇于承认、及时纠正、诚恳道歉，应该可以获得受害人与社会公众的宽恕和原谅，但疾控部门后来的做法，不仅损害了公民的权益，而且影响了医疗卫生部门的形象和公信力。有关部门应当及时调查错误根源，采取有效的补救措施亡羊补牢，通过完善相关监管机制与制度的完善来实现自我救赎。
