在去年的“两会”期间，两份关于要求制定广西艾滋病防治条例的议案引发关注（本报2010年1月30日曾做过报道），这两份议案分别由边疆等13名代表和由唐振柱等17名代表联名提出。2011年的“两会”召开在即，记者了解到，30位人大代表的呼吁引起了重视，自治区人大教科文卫委员会建议将制定《广西壮族自治区艾滋病防治条例》（简称《防艾条例》）列入2011年自治区人民政府和自治区人大常委会的立法计划。

 

现状：我区艾滋病疫情居全国第二位

在去年的“两会”上，人大代表唐振柱等联名提出的议案中称，目前我区艾滋病流行形势严峻，出现了许多新情况、新问题，已处于关键阶段，错过这一时期，后果不堪设想。首先是艾滋病疫情不断上升和蔓延，流行形势严峻。至2009年底，全区累计报告艾滋病病毒感染者5万多例，艾滋病人14000多例，死亡9000多例，居全国第二位。艾滋病疫情从高危人群向社会一般人群加速扩散，母婴传播的危险性正进一步加大。2009年性传播途径感染艾滋病达60%左右，超过注射毒品传播，男男性传播艾滋病速度也在加快。

人大代表认为，广西的防艾亟待立法规范，目前对艾滋病感染者的有效管理存在法律上的瓶颈问题，尤其是艾滋病感染者或病人告知制度存在缺陷。比如国家《艾滋病防治条例》规定要求“感染者需将感染或者发病的事实及时告知与其有性关系者”等，但实际生活中，部分人群缺乏自律，即使自己知道感染了艾滋病病毒，很少自觉告知其配偶或性伴侣，造成艾滋病扩散，导致多代感染者发生。该《议案》要求把婚检检测艾滋病病毒、梅毒等性病纳入我区基本公共卫生服务项目。

     

建议：对孕产妇提供免费咨询和检测

由唐振柱等17名代表提出的议案中，还拟有《广西壮族自治区艾滋病防治条例》（草案）。人大代表建议，在制定该条例时，要对宣传与教育、预防与控制、治疗与管理、保障与救助、法律责任等方面进行了规定。在预防与控制上，规定“申请结婚登记时，有关机构应当对申请人进行艾滋病防治知识宣传教育，提倡申请人接受艾滋病病毒抗体检测……”“医疗卫生机构应当对为孕产妇提供免费艾滋病防治咨询和检测，对感染艾滋病病毒孕产妇及其婴儿，提供预防艾滋病母婴传播的咨询、产前指导、阻断、治疗、产后访视、婴儿随访和检测等服务。”

 

结果：防艾有望列入今年立法

艾滋病已成为我区面临的重大公共卫生问题，目前实施的《广西壮族自治区艾滋病防治办法》与国务院颁布实施的《艾滋病防治条例》相比早了近3年，个别条文与上位法不一致，有必要进行修订，并由原来的政府规章上升为地方性法规。自治区人大教科文卫委员会建议将制定该项法规列入今年自治区人民政府和自治区人大常委会的立法计划，由自治区人民政府抓紧开展立法调研和起草工作，尽快提请自治区人大常委会审议。

Results: AIDS prevention is expected to be included in this legislation
