桂林生活网讯（记者宁永春 通讯员韦金明 黄琴）去年年底，一名患有艾滋病的犯罪嫌疑人针袭民警，被民警枪击致伤，引起广泛关注。记者1月11日从荔浦县公安局获悉，经当地公安及检察机关调查认定：民警是在多次警告无效、生命受到威胁的情况下被迫开枪自卫、制止非法侵害，属正当防卫，不负刑事责任。
去年12月22日下午2点半左右，在打击“两抢一盗”专项行动中，荔浦县公安局荔城派出所黄警官与另一民警乘摩托车便衣巡逻。巡逻中，黄警官发现韦某与丘某乘坐一辆无牌无证二轮摩托车，按要求，这类情况属盘查范围，随即上前盘查。
在黄警官出示证件表明身份后，坐在后座的丘某配合了检查，但韦某却不肯。他求情道，“你抓我多次了，就放我一回吧。”但遭到黄警官拒绝。
韦某见软的不行，就来硬的，从身上拿出注射器往自已手上扎，并抽血，然后拔出针头追扎黄警官。黄警官边防卫边警告：“你不要乱来！”但韦某根本不听。
就在针头就要扎到他时，黄警官用手挡开韦某的手，而后拔枪警告。但韦某并不理会，黄警官在来不及鸣枪的情况下，向韦某开了第一枪。中枪后，韦某更疯狂地扑向黄警官。黄警官被迫开了第二枪，打中了韦某左肋软组织。韦某这才停止侵害。
黄警官见韦某受伤后，立即组织救援，并向上级汇报。
据警方调查了解，韦某曾于1997年因犯抢劫罪被判刑8年。出狱后又因吸毒、偷盗等违法犯罪行为被公安机关先后查处7次。韦某因患有艾滋病，按现行法律规定属不宜羁押，因而变得无所顾忌，一而再再而三地作案。2009年底以来的一年多时间里，韦某曾被黄警官抓过三次，双方相识。
经当地公安及检察机关调查，黄警官开枪击伤韦某属法定的正当防卫情形，符合《人民警察法》、《公安机关人民警察使用武器与警械条例》等法律规定，不属防卫过当。
另外，当时在场的另一位嫌疑人丘某所反映的情况，与调查情况基本一致。
据悉，目前韦某已伤愈出院，检察机关以涉嫌妨害公务罪依法批准了对其的逮捕。黄警官则继续在民警岗位上履行自己的职责。
