女子未做检测被告知得艾滋病 经调解获赔一万元

25岁的年轻女子小丽（化名）在外打工期间，忽然接到了家里人的电话，告知其被检测出携带有艾滋病毒。这个消息犹如晴天霹雳，把小丽原有的生活彻底打乱了。那么，事情到底是怎么一回事呢？
冤枉：未做过检测却被告知携带病毒
2010年11月，在广东东莞打工的浦北女子小丽，忽然接到家里人打来的电话，电话里称：浦北县三合镇卫生院找到了家里人，告诉他们小丽在浦北县疾控中心被检测出携带有艾滋病毒，此结果已经在卫生部门的艾滋病专报网上通报，希望小丽回家复检。
接到这个电话，小丽忐忑不安又充满了疑问：她已经结婚数年，和爱人育有一个三岁的女儿，一家人一直健康愉快，2010年2月，小丽随亲戚前往东莞打工，在此期间也没回过浦北。而且在小丽的印象中，她从来没有到医院进行过血液方面的检查，更没有到当地疾控中心做过艾滋病毒的检测。那么这份报告从何而来？
小丽带着疑问回到浦北，于2010年11月24日前往浦北县疾控中心进行复检。12月6日，小丽拿到了两份结果迥异的报告：一份是2009年3月20日由钦州市疾病控制中心给出的，显示其“HIV抗体阳性”的报告；另一份则是本次复检显示的“CD3、CD4、CD8、淋巴细胞正常”的报告。在前一份报告上，小丽还发现，这份检测报告与她本人的家庭住址、学历等信息都不相吻合。
与此同时，小丽“携带艾滋病毒”的流言已经在当地传开了，各种流言蜚语让小丽终日以泪洗面、寝食难安。婆家人不仅数落小丽作风有问题、不让她靠近丈夫和女儿，还在领到检测报告的第二天逼着小丽夫妇到当地民政部门办理离婚手续。为了这份莫名的检测报告，小丽的父亲和哥哥决定带着小丽到自治区一级的卫生部门再一次复检。
2010年12月11日，小丽在广西区人民医院皮肤性病科检测后获知，她的艾滋抗体以及梅毒两项均为阴性。看到这个结果，小丽和家人决定将浦北县疾控中心以及钦州市疾控中心告上法庭。
诉讼：被告辩称此“李X”非彼“李X”
2月21日，小丽状告浦北县疾控中心、钦州市疾控中心一案开庭审理。在小丽的民事起诉状中，小丽要求被告“停止侵害、恢复名誉”，同时还要求被告在艾滋病专报网去除自己的名字并赔偿各种经济损失。
为此，被告方钦州市疾控中心认为，他们只是针对浦北县疾控中心送检的样本进行检测，与原告小丽并没有发生过委托检验合同关系或谋面商议有关事宜，因此不承担任何责任。
而另一被告方浦北县疾控中心辩称：2009年3月12日送检的样本，并不是此案中小丽的样本，而是一名与小丽同名同姓同年龄同住址的案外人“李X”的样本，根据样本显示其携带有艾滋病毒，浦北县疾控中心只是按照相关规定将“李X”的名字上报到艾滋病专报网，并无意损害小丽名誉——也就是说，此“李X”非彼“李X”，浦北县疾控中心将一份同名同姓的报告错送给了小丽。
浦北县疾控中心还辩称，该中心只是将小丽的名字上报到了内部网站，并不对社会公开，因此没有给小丽的名誉造成损害。另外，小丽明知自己没有做过HIV检测而误领了该份报告，也有部分过错。
探因：制度纰漏导致报告送达出错
经过法庭上的一番调查和辩论后，原告方小丽和被告方浦北县疾控中心达成了调解协议：由浦北县疾控中心赔偿小丽1万元的各种经济损失。
那么，这件事情为何会发生呢？记者为此找到了浦北县疾控中心相关负责人。据了解，在2010年以前，艾滋病检测并不采取实名制，而是依据个人送检样本出具检测报告并上报上级单位以及各个通报网站，恰好在2009年3月，有一位与小丽同名同姓同年龄同地址的“李X”，亲自到浦北县疾控中心进行了艾滋病检测。
2010年新政策出台以后，进行艾滋病检测都需要采取实名制。与此同时，根据相关法律规定要求随访艾滋病患者的浦北县疾控中心，多次到“李X”的家庭住址寻找此人都毫无结果后，便要求当地派出所根据名字详查户口，接着他们就找到了与该“李X”同名同姓的小丽。因此，在未经过身份证核实和登记资料核对的情况下，小丽就这样莫名其妙地为那个同名同姓的“李X”背了黑锅。
为此，疾控中心的相关负责人也表示，原有的制度的确存在一些漏洞，导致实际操作时出现偏差。今后有市民遇到类似情况，一定要详细询问并核对好本人的身份信息，以免出现类似的误解。
