首例艾滋病就业歧视案调查:法律未明示体检标准

艾滋病病毒感染者能否从事教师行业？
安徽省安庆市教育局给出了否定的答案。
但，艾滋病病毒感染者小王(化名)并不这么认为，他将安徽省安庆市教育局告上了法庭，坊间称其为“艾滋病就业歧视第一案”。
10月13日上午9时，安庆市迎江区法庭审理此案。鉴于该案判决结果的社会影响巨大，法院没有当庭宣判。据介绍，一审结果最迟将于11月底宣布。
在庭审后不久，安庆市教育局副局长吴功华接受了《中国经济周刊》的独家专访。他说，“我们很同情他，但是亲情代替不了法律，我们是依法招录。”
“我希望姚明、彭丽媛、濮存昕这些艾滋病防治宣传大使可以公开地对我表示支持。”小王告诉《中国经济周刊》：“他们只要说一句‘艾滋病感染者可以当教师’就行了。”
体检“不合格”被拒录
今年5月6日，安庆市教育局发布《2010年安庆市直学校公开招聘教师公告》。5月29日，小王参加了安庆市教育局组织的考试。在这次公开招聘教师计划为80名的考试中，小王先后通过了笔试、面试。
7月12日，小王在安庆市立医院进行了体检。“我们拿到医院提供的体检单显示为‘不合格’，并将这一结果告诉了他。他要求复查。医院对他进行第二次复检，报经安庆疾控中心，二次体检结论依然是不合格。教育局于是作出‘体检不合格，不予录用’的决定。”吴功华介绍说，“最初我们并不知道他是什么病，也没有对外透露任何关于他本人的信息，也没有告知其本人是什么病。后来，我们通过媒体报道才知道是艾滋病。”
小王的体检结果显示是HIV1(人类免疫缺陷病毒的其中一种)抗体呈阳性。但是吴功华拒绝展示体检单，“因为这涉及到小王的个人隐私”。
小王认为，自己是处于潜伏期的“艾滋病病毒携带者”，在工作能力上与其他人并无任何不同，教育局以体检不合格不予录用的行为违法。上诉书要求被告录用原告为安庆市市直学校教师。
但是教育局的拒录并非无理可据。
在此前发布的招录公告中显示：“按照《公务员录用体检通用标准》，体检不合格取消本次聘用资格”。
吴功华引用《公务员录用体检通用标准》的规定说，与乙型肝炎病毒携带者不同，不存在“艾滋病病毒携带者”这一概念，所以没有“艾滋病病毒携带者”的说法。这是因为HIV感染后几乎100%都会发病。“所以，HIV感染的诊断一经确认，即作体检不合格的结论。”
中国疾病控制中心性病艾滋病预防控制中心治疗与关怀室一位不愿透露姓名的专家告诉《中国经济周刊》：“艾滋病病毒携带者”这个说法我们一般不提，HIV病毒感染后分为急性、无症状和艾滋病人三个阶段，我们一般的提法是“HIV感染者”或艾滋病人。
中国疾病预防控制中心性病艾滋病预防控制中心首席专家、病毒与免疫研究室主任邵一鸣则告诉《中国经济周刊》：“有‘艾滋病病毒携带者’的说法，是指全部感染HIV的人，包括没发病和发病(艾滋病人)的；HIV感染后不是100%都会发病，有特例，即长期存活者，尽管这部人较少。从HIV感染到50%的感染者发病(平均潜伏期)的时间约为7～8年， 感染20年后仍不发病的小于10%。”
参照公务员招考标准是否“歧视”
在庭审中，“公务员招考标准是否适用教师招考”、“公务员录用体检通用标准是否合法”成为辩论焦点。
原告辩护律师之一、北京瑞风律师事务所李方平表示，教师不是公务员，教师招聘按照公务员体检标准拒录艾滋病病毒感染者不合法。
吴功华向本刊记者提供了一叠与安庆市教育局招录有关的法律文件，如《教师法》、《传染病防治法》、《教师资格条例实施办法》、《安徽省教师资格实施细则》等规定，并指出教师岗位对身体条件有明确要求，有传染病或精神病史的人不得从事教师职业。
吴功华介绍说：“国家未出台事业单位公开招聘体检标准，各地政府可根据自身工作需要自行制定。”记者了解到，安庆市在2008年出台了《安庆市市直事业单位公开招聘人员和选调人员办法(试行)》，其中第十六条规定：“体检标准可参照公务员录用体检”。安徽省人事厅《关于省直事业单位新进工作人员公开招聘工作的通知》第十二条同样规定：“体检执行我省公务员体检标准。”
在安庆市教育局看来，在安庆市市直学校公开招聘教师公示中规定按照《公务员录用体检通用标准》对应聘人员进行体检，对全体应聘者统一适用，不存在歧视。
对此，原告辩护律师之一、安徽江淮律师事务所郑继能认为：“不同行业的从业人员有不同的身体要求，公务员有公务员体检标准，教师、军警各有体检标准，工矿企业工人又有不同的标准。为什么对教师招考非得适用公务员体检标准？”
原告辩护律师之一李方平认为，艾滋病病毒感染者(携带者)依法享有平等就业的权利。他援引2008年1月1日起施行的《就业促进法》规定：“用人单位招用人员，不得以是传染病病原携带者为由拒绝录用。”
吴功华反驳说：“这是《就业促进法》第三章第三十条的规定，他引用的这个法律条文后面还有一句话：‘但是，经医学鉴定传染病病原携带者在治愈前或者排除传染嫌疑前，不得从事法律、行政法规和国务院卫生行政部门规定禁止从事的易使传染病扩散的工作。’”？
“他们在法律条文上断章取义，引用后面基本都有‘但是’。” 吴功华强调说。
在快速城市化的过程中，“安庆市每年都要补充教师，我们每次都是按计划和有关规定公开招聘，教育局与人事局、监察局联合参与。整个招聘程序依规合法。我们一直在很严谨地做事。”
安庆市教育局现在很为难。
“我觉得社会要真正去关心这位同学，希望能保护好他的隐私，同时也希望他能积极治疗，早日找到适合自己的工作。”
吴功华认为，教师这个岗位不适合他，“教师是个面对广大中小学生和未成年人的特定岗位，国家对这一岗位的资格条件有着特定的要求，为了对学生负责、对社会负责，必须严格执行国家法律法规。”
安庆市教育局认为，原告作为一个具有完全民事行为能力的成年人，在明确了招聘公告内容的情况下参加报名，就表明其愿意按照统一的标准进行公平竞争。
作为案件的当事人，小王并没有出现在法庭上，他在离安庆城区200多公里外的一个县城里平静而焦灼地上着课。由于种种原因，从省外师范类本科院校毕业的他在一所学校当代课教师，工资只有微薄的1000元左右，只能勉强糊口。因此，在北京益仁平中心的帮助下，小王打起了这场官司。小王说：“我觉得这(打官司)是和生存联系在一起的，没有经济来源怎么办？我的想法很简单，就是想要一份好工作，可以有钱治病。”
在安庆采访期间，一些公众对小王适不适合当老师作出自己的判断。学生家长、安徽野娃食品公司董事长何坤告诉记者说：“我是不愿意的，如果是你的孩子你愿意吗？”
法律漏洞或引起更多歧视
联合国艾滋病规划署数据显示，到2009年年底，我国存活的艾滋病感染者和病人有74万人。“如果各行各业都按照公务员体检标准来招聘人的话，艾滋病病毒感染者就无法找到任何工作了。” 北京益仁平中心总负责人于方强说，就业歧视现象层出不穷，一些政策有待完善，政策漏洞有待弥补。
郑继能律师解释说：“《公务员体检通用标准》制定于2005年，之后颁布的《艾滋病防治条例》第3条规定：艾滋病病毒感染者、艾滋病病人及其家属享有的婚姻、就业、就医、入学等合法权益受法律保护。《就业促进法》第30条规定：用人单位招用人员，不得以是传染病病原携带者为由拒绝录用。在条例公布后，有关部门却一直对自行制定的规范性文件不予修改。抱着各自部门的文件规定不放，视法律而不见而一味强调其行为符合文件规定，与掩耳盗铃有何区别？”
“新法优于旧法，旧法、规范性文件必须依新法做修正，但是一些部门迟迟不改。”郑继能律师说。
与此同时，《教师法》规定“国家实行教师资格制度”，教师招考适用体检标准都必须在法律的授权下依法进行。但至今为止，法律和行政法规都没有授权国家行政机关招考教师适用或参照哪一体检标准。
《教师法》没有对体检作出规定，而《传染病防治法》、《就业促进法》规定只能由卫生部制定传染病限制(禁止)就业规定。目前，卫生部尚未出台有关规定。《〈教师资格条例〉实施办法》第13条规定“体检项目由省级人民政府教育行政部门规定，其中必须包括传染病、精神病项目”，但是对传染病全部禁止，还是部分禁止？迄今尚未有明确表示。

我认为“洁身自好、远离艾滋”是一种恐吓式宣传
《中国经济周刊》：你当时参加考试的过程是怎样的？
小王(化名)：当时的考试可谓是轰轰烈烈。安庆市直属学校大概招录200名左右教师，但是，报名的就有2000多人，可见当今社会的就业形式之严峻。我笔试、面试都很顺利，可能是基础比较好吧，也可能是运气比别人好。
《中国经济周刊》：你此前知道自己有这个病情吗？是否方便透露你是如何成为艾滋病病毒感染者的？
小王：就是因为安庆市的这次体检，我之前一直不知道，具体感染途径我也不太清楚。
《中国经济周刊》：如果无缘教师行业是不是很遗憾，将来怎么办？
小王：我有当教师的实力，却因一张体检表断送了我的教师梦想，是有遗憾。对将来，我还未做打算。
《中国经济周刊》：打官司以后，你的压力会不会很大？
小王：对，很大，一方面担心官司的结果，一方面担心隐私会被暴露。
《中国经济周刊》：如果官司赢了，你会去安庆市的相关学校上班吗？
小王：还要考虑。
《中国经济周刊》：现在家里知道你的病情吗？家里的经济条件如何？
小王：不知道，我怕他们担心。家里是农村，经济条件不好，爸妈都是指望我毕业后能找到一份好的工作来缓解家里的压力；我也盼着毕业后找份好的工作，好好孝敬他们，他们都忙活了大半辈子了，都是为了我。
《中国经济周刊》：对现行《公务员体检通行标准》进行修改，是你最大的愿望？
小王：是啊，如果各行各业都用这个标准，我们艾滋携带者就找不到任何工作了，有劳动能力的人却不能有劳动的权利，这是何等的悲哀！而且，连《公务员体检通用标准》都涉嫌健康歧视，特别是艾滋歧视，这叫普通人怎么不歧视，不恐惧。
《中国经济周刊》：安庆市的一个出租司机说：他理解你的状况，但是“如果他要教我的孩子，我肯定不乐意，因为他的手要是破了，我孩子的手也破了，那可怎么好？” 你如何看待他的立场？
小王：我手破了的概率有多少？我手在教室里面破了的概率有多少？他的孩子的手破了的概率又有多少？他的孩子的手在教室里面破了的概率又有多少？我们两个人的手同时破了，概率有多少？同时血液交融在一起，那概率又有多少？
世界卫生组织告诉我们，艾滋病只通过母婴、血液和性三种途径传播。你见过教师需要通过生孩子、换血液或性的方式传授知识吗？没有。我上课主要是说话加粉笔。所以我认为这种担忧是不必要的。但退一步说，这是个人行为，我无权强迫他人改变观念。但这也的确说明，我们国家的艾滋病宣传教育方式是失败的，耗费了巨大的人力、物力、财力，大家还是非常恐惧艾滋病。
比如“洁身自好、远离艾滋”这个宣传口号，就是一种恐吓式的宣传策略，虽然有一定的效果，但从长远来看，这是失败的策略。这种说法的弊端很多，它往往让人对艾滋携带者和病人戴上有色眼睛，往往在道德层面上去评判艾滋。“远离艾滋”更是错误，这会让别人觉得是要远离艾滋携带者和病人，而不给与人性上的关怀。
