记者从安庆市中院获悉，备受关注的我国首例艾滋病就业歧视案原告小吴不服一审判决上诉后，安庆市中级人民法院于近日宣判：驳回原告小吴上诉。
2010年初，安庆小伙小吴报名参加了安庆市教育局组织的安庆市市直学校教师招聘考试，于2010年5月19日参加了笔试。笔试通过后，他又通过了6月28日的面试。7月12日，在安庆市教育局的安排下，小吴在安庆市立医院做了体检。然而，体检过后，小吴被确认“HIV-1抗体阳性”。安庆市教育局对小吴作出了按照公务员体检标准“体检不合格，不予录用”的决定。小吴认为，自己报考的是教师职位，而教育局按照公务员体检标准拒绝他是违法行为。处于潜伏期的“艾滋病病毒感染者”在工作能力上与其他人并无任何不同，法律明文规定保护劳动者的平等就业权，于是8月27日，小吴将安庆市教育局与安庆市人力资源和社会保障局告上法庭，由于该案是我国首例艾滋病就业歧视案，引发社会的强烈关注。
安庆市迎江区法院经审查，于当年8月30日决定立案审理。当年10月13日上午，安庆市迎江区法院不公开审理了该案。经安庆市迎江区人民法院审判委员会讨论决定，2010年11月12日下午3点，该院认为被告作出的不予录用决定事实依据充分、程序合法、适用法律亦无不当，判决驳回原告小吴的诉讼请求。
一审宣判后，2010年11月29日，小吴向安庆市中级人民法院提起上诉，并在近日收到终审判决。
经审理，安庆市中级法院认为，教师属于事业单位工作人员，根据安庆市规定，教师应聘应参照《公务员体检标准》：“淋病、梅毒、软下疳、性病性淋巴肉芽肿、尖锐湿疣、生殖器疱疹，艾滋病，不合格。”最终中级法院最终驳回上诉，维持原判。驳回原告小吴的上诉。(记者：黄娜娜)
