·在医院输血感染艾滋病？

王辰新（化名）因腰椎间盘突出到医院进行手术，在手术中进行了输血，多年后，王辰新经过检查发现自己竟感染了艾滋病病毒！
“我只在蚌医附院输过一次血，平时生活检点，输血多年后查出感染艾滋病病毒，这绝对是医院的问题！”在恐惧和担忧中，王辰新将医院告上法庭索赔近50余万元。目前，蚌埠市中院正在二审开庭审理此案。
A输血几年后身体逐渐变糟
今年58岁的王辰新是蒙城县农民。1995年2月至3月期间，他因腰椎间盘突出病到中国癌症研究基金会安徽肿瘤康复医院（现在的蚌埠医学院附属医院康复部，以下简称蚌医附院）住院治疗。医院选择手术进行治疗，在手术中由于王辰新失血，医院又对其进行输血。
可没想到，几年后，王辰新的抵抗力突然变得非常差，无缘无故经常感冒发烧，并且咳嗽、腹泻，有时高烧达40℃。而且原来他一餐可吃两三大碗面条，到后来食量大减，到最后连一小碗面条都吃不完。王辰新家人都慌了神，带着他四处求医。可检查下来，一直没有查出什么原因。
“当时我以为是父亲身体衰老，抵抗力下降了，养养身子可能会好起来。”王辰新的儿子王伟说，可是，治疗几年来，王辰新的身体越来越差，不但经常发病，人也瘦了一圈，医药费每年都要花数千元。
B胃镜检查发现感染艾滋病
因为身体状况长期没有改善，担心王辰新的胃出现大问题。
在2008年5月，王辰新被家人送到蚌医附院作胃镜检查。医生一番检查后，发现王辰新竟然感染了艾滋病病毒。
当王辰新家人拿到报告单后，一下子全都瘫在了地上。
之后，王辰新又到蚌埠市疾病预防控制中心检测，疾病预防控制中心的检验结果显示“HIV抗体阳性”，他感染了艾滋病病毒！对于这样的结果他不敢相信，其妻子也到疾病预防控制中心检测，结果显示妻子“HIV抗体呈阴性”。
他彻底绝望了，排除妻子传染给他的可能性，因此他怀疑是医院在输血过程中出现问题。
C村民恐慌聊天时回避病人
在王辰新患艾滋病的消息传开后，他和家人的生活因此发生了巨变——因对艾滋病的担心，除了几个亲朋好友外，许多村民都对他敬而远之。现在由于病毒感染视神经，他现在眼睛已经基本上看不见物体，日常生活完全靠家人照料。
王辰新的儿子王伟称，父亲原来是家中的顶梁柱，以前父亲还能开小店挣些钱，现在他只求父亲好好活着。
王伟告诉记者，在得知消息后，村民们都很紧张，大家心里比较害怕，都尽量避免跟他们接触。
虽然疾控部门和村卫生室的工作人员反复宣传不要歧视艾滋病患者，也再三强调艾滋病只有血液、性、母婴三种传播方式，但人们还是信不过，当父亲偶尔出门想参加大家的聊天时，大家就会慢慢地散开去。而他父亲也对此非常敏感，把自己碗筷等物品和家人的分开。
莫名其妙感染艾滋病病毒，王辰新家人多次找医院协商无果，面对巨额开支，将蚌医附院告上法庭索赔计50余万元。其中，医疗费20万元及精神损害抚慰金10万元，每年赔偿营养费7300元、误工费22180元。
在一审过程中，蚌医附院表示给王辰新输的血液是从蚌埠市中心血站购买，而且不能排除王辰新通过其他途径感染艾滋病。按照有关医学条例和采血规范，如果是血站所供血液，在血袋上应该贴有标签，血液使用后标签应当附在病历中待查。
蚌埠市龙子湖区法院在审理时认为，蚌医附院由于自身原因，不能举出采血标签等能够明确血液具体来源的证据。因此法院一审判决，由蚌医附院承担部分责任，并且赔偿王辰新精神损害抚慰金50000元；驳回王辰新的其他诉讼请求。
一审宣判后，王辰新、蚌医附院不服，双双提出上诉。
D该案二审已经开庭审理
“遇到这事我已很难过了，没想到医院不愿承担责任！”王辰新认为，一审判决赔偿数额极低。“我计算的这些费用都是按每天所需实际计算出的，众所周知感染上HIV病毒，人的抵抗力会下降，会得多种疾病，甚至丧失劳动能力和生活自理能力，这些费用应得到支持。”
对于王辰新的情况，2月2日，记者来到蚌埠医学院附属医院康复部，康复部主任于伟荣告诉记者，他是2008年才来到该部门的，原来情况自己并不太清楚，现在由于该案已经进入二审阶段，相信很快就会有个结果。
他同时表示，对于王辰新的情况，他个人表示非常同情。而该院有关人士也承认，由于医院缺乏完整的证据链，因此才会导致一审要承担部分责任。据悉，蚌埠市中院已经开庭审理此案。
记者调查
血液从供血者到患者身上，要经过什么过程和检验？患者拿到的血是否安全？昨天，就市民关心的这些问题，记者进行了调查。
蚌埠市中心血站质控科科长余加宏介绍，现在主要采取义务献血的方式收集血样。在献血车上献血时，只检测3项内容即血型、乙肝、血红蛋白。
当血液送回血库后，至少还要经过两次检测，即初检、复检，这两次检测都非常严格，包括HIV、乙肝、丙肝、梅毒等7项内容。
“只要发现其中一项不过关，都不可能接受献血。”余加宏表示，国家对用血安全非常重视，出台了很多规范措施和办法，对每个程序都严格控制，血液中心在确认血液安全的情况下，才能提供给临床受血者使用。
那医院在使用血液前会不会再次检验？记者采访了蚌医附院等几家医院，得到的答复是“不会”。
据医院有关人员表示，医院拿到的血样是密封的，而且之前已经过严格的检验，所以医院有理由相信从血库拿到的血液是检验合格的，同时为了防止二次污染，医院在使用前不可能再进行检验。
但在众多疾病中，艾滋病是个特殊的例外。HIV病毒感染人体，到体内产生出HIV病毒抗体必定要经历一个过程，这段过程所需的时间称为“窗口期”，在“窗口期”HIV病毒感染者的血液是检测不出HIV病毒抗体的，检验的结果都呈阴性，而“窗口期”一般为2~6周。
“这是个世界性问题，目前都没办法解决！”蚌埠市中心血站副站长沈军表示，正因为艾滋病存在“窗口期”问题，“所以我们一直提醒大家，输血有风险。患者在用血前医生都会告知输血的风险性，只有在患者签字同意的情况下，医生才会给患者输血。”
