永清法院成功调解首例艾滋病感染损害赔偿案
近日，永清县法院民一庭法官经过近半年的艰苦努力，成功调解了首例艾滋病(简称HIV)病毒感染损害赔偿纠纷案，由被告永清甲医疗机构和廊坊乙医疗机构一次性赔偿原告王某治疗费、精神损害抚慰金以及今后的治疗费、检测费、护理费、误工费、营养费、被抚养人生活费等损失共计30万元。
1995年1月23日，原告王某因妊娠入住永清甲医疗机构分娩，在生产过程中出现大出血，生命垂危，急需输血。据原告介绍，当时血站尚未成立，永清甲医疗机构临时找来五名献血员从其身上直接抽取后输入到王某体内。次日，原告病情未见好转，又转至被告廊坊乙医疗机构，在廊坊乙医疗机构输血400毫升。出院后不久，原告被确诊患了丙肝，多年来四处求医也未能治愈。2004年起原告开始出现浑身乏力，全身疱疹、皮炎、经常低烧等症状。2008年7月，在四处治疗均无效的情况下，原告来到北京丙医疗机构住院治疗，被检测出艾滋病毒、丙肝双重感染，艾滋病已进入发病期。病情被确诊后，对王某及其家人精神上造成极大损害，在自我排除其他被感染途径的情况下，王某认为其系输血引起病毒感染，遂依法提起了诉讼。
