而被告的代理律师,则也是根据《公务员录用体检通用标准》中的第十八条“淋病、梅毒、软下疳、性病性淋巴肉芽肿、尖锐湿疣、生殖器疱疹,艾滋病,不合格”的规定认为,拒绝录用艾滋病病毒携带者当教师是属合法行为。
昨天法官并没有有当庭宣布一审结果,而是鉴于案件的特殊性,将庭审情况提交审判委员会合议后再另择时间宣布一审结果。
对于最后的一审结果,原告的代理律师许兴华昨晚庭审结束后表示了明显的乐观,认为“能赢,因为盐边县教育局、人事局的行为明显违法”。
按照相关法律程序,一审宣判结果出来后,不服判决者,将可向上一级的攀枝花市中级人民法院申请二诉。

原告小军的代理律师许兴华是公益律师,曾代理了去年轰动全国的“云南小学生卖淫案”,现供职于北京昌久律师事务所昆明分所。
许兴华律师表示,在这起案件中,盐边县教育局至少做出了两个错误决定:一是拒绝录用小军,违反了《就业促进法》第三十条“用人单位招用人员,不得以是传染病病原携带者为由拒绝录用”的规定,是明显的就业歧视;二是当地人事局和教育局以非常不恰当的方式传播了小军感染了艾滋病毒这样一个事实,应该承担相应责任。
许兴华律师也因此表示:“艾滋感染者隐私急需立法保护。惧怕个人隐私被泄露,已经成为艾滋病病毒感染者反歧视法律维权的一大障碍。有一部执行力强的《个人信息保护法》对推进社会法治非常重要。”

■建议国考消除“艾滋歧视”
据悉,目前民间反歧视公益组织北京益仁平中心已向人力资源和社会保障部、卫生部寄送建议信,建议国考消除“艾滋歧视”。据该组织负责人于方强介绍,这封长达5000字的建议信指出,公务员体检标准中对艾滋病病毒感染者的限制,违反我国宪法和法律的相关规定,应当尽快删除或者修改该标准中造成对艾滋病病毒感染者歧视的条款,保护艾滋病病毒感染者平等就业权。

体检呈阳性应聘教师被拒
出生在四川省大凉山贫苦农民家庭的小军(化名),通过自身努力,考上了当地一所师范学校的音乐师范专业。
2010年6月,小军报名参加了盐边县事业单位教师岗位考试,报考了攀枝花市盐边县小学音乐教师的岗位。8月9日的笔试后,8月20日,在小学音乐类岗位以第二名的优异成绩进入面试。23日,通过笔试和面试的小军,进入体检程序。
8月26日,县教育局就组织这些参加体检的“准教师”进行48学时的新教师上岗培训,并由盐边教育培训中心开具了培训证明。培训期间,县教育局确定了小军的任教学校,并要求小军在8月31日前报到任教。隔天,又电话通知小军,称其体检结果有问题,需要进行复检。

艾滋病毒感染者不等于艾滋病人
从医学上讲,艾滋病病毒感染者,是指艾滋病病毒抗体阳性,这和平时所说的艾滋病人是有区别的,无症状或者不能诊断为艾滋病病人者都仅仅是艾滋病病毒感染者。
