艾滋病人没有犯罪特权南海网

河南一些艾滋病人将艾滋病作为“护身符”，以看病或需要救助为幌子，大肆寻衅滋事、敲诈勒索过往车辆司机钱财。迫于“查处难”“羁押难”“执行难”压力下的警方只能一次次上演“捉放曹”。日前，面对犯罪嫌疑人的肆无忌惮，“忍无可忍”的民警顶着“三难”将其中一名“携”艾滋病病毒多次作案的犯罪嫌疑人抓获。《法制日报》
艾滋病人凭借自己的特殊身份进行违法犯罪活动的并非个别现象，而很多民警出于自身安全的考虑，只要他们没犯下杀人、强奸之类的重罪，一般也不会去管。结果那些艾滋病犯罪嫌疑人的胆子越来越大，成了地方一霸。受害群众无处伸冤，只得以暴制暴，因此酿成严重后果的事件并不在少数。2009年3月震惊全国的擦鞋匠怒剁艾滋患者案，就是因为受害人利用自已艾滋病人的身份四处敲诈，擦鞋匠报警无用，又被敲诈者持刀威胁，一时激愤，才夺刀杀人的。
对敲诈勒索行为，我国刑法和治安处罚法都有明确的处罚规定。法律面前人人平等，艾滋病人并没有豁免权。只要犯罪嫌疑人实施了敲诈勒索行为，警方就应依法惩处，不能因对方是艾滋病人就网开一面。没有条件对其羁押，不是宽容犯罪的理由。不抓艾滋病犯罪嫌疑人，警察是安全了，可老百姓的生命和财产安全又该由谁来保护呢？
艾滋病犯罪嫌疑人可能传染他人，和其他囚犯关一起不合适。但看守所或监狱总有单间吧？只要民警和医生做好防范措施，这应该不是大问题。如果因为犯罪嫌疑人有艾滋病就不抓捕，只会助长犯罪分子的嚣张气焰。今天只是敲诈勒索，明天就会公然抢劫，甚至当街杀人，社会岂非永无宁日。现在的传染病多了，艾滋病人不抓，肺结核、肝炎、疟疾、梅毒患者犯案是不是也不能抓，毕竟他们也可能传染人，病毒同样可以通过血液甚至空气传播，危险性并不亚于艾滋病人。
艾滋病不是免罪金牌。警方的“忍让”不仅会纵容犯罪嫌疑人继续犯罪，还可能引来更多的效仿者。很多地方都出现过手持伪造的艾滋病检测报告敲诈的案件，犯罪分子正是利用了常人和警方对艾滋病的恐惧心理来行骗。如果警方对此类行为不加干预，也许不久之后，艾滋病检测报告和针筒就会成为街头混混、惯偷、劫匪们的必备作案工具。
艾滋病囚犯并非没有监狱或看守所收押，北京的金钟监狱就是专门关押传染病犯和艾滋病囚犯的监狱。湖北等省市也在看守所或监狱中设置了专门的监区来收押这些特殊囚犯。其他有艾滋犯罪嫌疑人的地区也完全应该投资兴建类似场所。即使现在没有，也可通过省市司法互助管道，将犯罪嫌疑人转移至外地有羁押条件的看守所或监狱中关押。
一些艾滋病犯罪嫌疑人犯罪的起因并非贪财，而是因患病失去了基本生活来源，又被家人抛弃、邻里嫌弃，自暴自弃下才会走上犯罪道路。如果有关部门和当地政府平时能够多给他们一些关心照顾，他们未必会做这种糊涂事。无论是从人道主义还是从社会稳定的角度出发，对艾滋病患者,我们都应给予他们更多的关心。违法犯罪者固然要受到应有的惩处，对那些没有劣迹的也不能任由他们在社会上游荡，政府相关部门应妥善解决好他们的医疗和生活问题。
