甘肃"艾滋患者"4年后被宣布痊愈 状告疾控部门

西部商报2月6日报道 2007年10月，省、市、县三级疾控中心工作人员来到天水市清水县瓦寨村村民李建平家中，宣布2003年8月被“确诊为艾滋病患者”的李建平已经痊愈。突来的消息让李建平很是震惊，从“确诊为艾滋病人到痊愈”，李建平的人生经历了诸多波折。之后，李建平一直想搞清楚“我的艾滋病是怎么得的？又是怎么好的”，为此他奔波于三级疾控中心之间，但至今未得到答案。2010年2月3日，李建平向兰州中院递交了一份诉状，将省、市、县三级疾控中心告上法庭，要求三被告赔偿其各项经济损失310万元，并为其恢复名誉。据了解，兰州中院对这起人身损害纠纷案已审查立案，不久将公开开庭审理。
被确诊“患艾滋”
李建平在诉状中称，2003年7月，天水市清水县金集镇瓦寨村村民李某因病经医治无效死亡后，被天水市第二人民医院确诊为艾滋病患者。同年8月，金集镇卫生所立即对瓦寨村近100名村民进行了采集血液样本检验。由于死者李某是李建平的邻居，李建平曾照顾过对方几天，因此李建平也参加了集中血液采样。约一周过后，清水县疾控中心和金集镇卫生院的工作人员来到李建平家里，郑重宣布李建平是“艾滋病患者”，并且说明该村村民还有几个也是艾滋病患者。清水县疾控中心的工作人员还明确告诫李建平“不得外出，不得工作”，并要求李建平要配合每季度的采集血样的检测和政府的跟踪服务。随后，清水县疾控中心和金集镇卫生院工作人员带上镇派出所的民警，用警车将正在天水市北道区打工的李建平的妻子张女商，带回金集镇卫生院强行采集血样样本进行检测。结果发现张女商和两个孩子均正常。但清水县疾控中心工作人员仍然要求张女商和李建平一样“不得外出”。
被宣布“病痊愈”
自从被确诊为“艾滋病患者”之后，一季度一次的血液检测成为李建平日常生活中的一部分。每次采集完血样后，李建平都要向清水县疾控中心的张主任咨询病情，张主任每次都说CD值的指数很高，“好着呢。”2006年底，清水县疾控中心通知李建平去领取国家关怀艾滋病人的补助。在领取补助的时候，一名大夫突然询问李建平：“你们村是不是还有一名叫李建平的村民？”李建平告诉他，是还有一个叫李建平的村民，他俩年龄相同。李建平追问工作人员问这个什么意思时，对方含含糊糊地说了句：“是不是搞错了。”李建平再问的时候，对方便不再回答。事后李建平开始疑惑：“难道他们搞错了？我根本就没有得艾滋病？”过了几天，村里的另一个李建平被通知去采集血液样本检测，但结果是阴性正常。
2007年8月，清水县疾控中心组织艾滋病患者体检时没有通知李建平参加。就在被确诊为“艾滋病患者”的4年时间里，李建平的身体无任何异常反应。而在此期间，李建平根本不懂CD值是什么。同年10月13日，李建平来到天水市疾控中心，自费进行了一次采集血液样本检测，而这次的结果表明李建平的CD值指数在800以上，病毒几乎为零。10月15日，李建平联系到了清水县疾控中心主任，得到的答复是：“正在下乡。”李建平直接与甘肃省疾控中心取得联系，要求到省疾控中心进行血液检测，省疾控中心工作人员让李建平不要到兰州，他们来天水找李建平。
2007年10月19日，省、市、县三级疾控中心的工作人员一起来到李建平家中宣布：“李建平的艾滋病已经好了！”听到“病好”两字之后，李建平哆嗦了一下，就跟当初被宣布得病时一样，他的大脑一片空白。过了一会，才觉得有些不对头,赶紧把村支书喊来，让其做个见证人。
讨说法没人理
被宣布“病好了”之后，平静下来的李建平越想越不对劲，觉得这4年的罪不能白受，总得有一个说法。于是他奔波于省、市、县三级疾控部门，但至今没有人正面给李建平解释其从“被艾滋”到“被痊愈”的蹊跷过程。李建平认为，三级疾控部门均在2003年确认自己是“艾滋病患者”，并且对自己的妻子和子女限制人身自由采集血样样本，之后每年采集血液样本予以检测，直至2007年10月19日被确认“艾滋病痊愈”了。李建平感到费解：“自己的艾滋病是怎么好的？”李建平确信，答案只有一个，肯定是自己压根就没有患病。而由于三级权威部门随意妄下结论，导致自己一家人长时间生活在恐惧中，遭受了巨大的精神打击和痛苦，加剧了家庭的生活困难，承包地荒废，至今全家生活没有着落。经过慎重考虑后，李建平将省、市、县三级疾控中心告上法庭。2月4日，记者联系到了李建平的代理律师，他只表示法院即将开庭审理。
