23岁农民自称“海归” 谎称得艾滋骗女网友13万

扬州23岁的农民王刚(化名)，凭着自己斯文的外表和“不俗”的谈吐，在网上自称“海归”，并认识了有夫之妇张丽(化名)，此后二人关系越来越密切。王刚先后以出国发展和得了艾滋病为由，骗取张丽人民币13.5万元。近日，王刚被一审判处有期徒刑8年，并处罚金10万元。
今年23岁的王刚是扬州市郊某镇的农民，平时游手好闲，经常上网打发时间。2005年11月的一天，他在网上认识了有夫之妇张丽。聊天中，王刚自称是从阿拉伯国家归国的“海归”，谈吐幽默又不失风度，很快让张丽有了好感。不久，二人从网络世界走到了现实生活，关系日渐密切。
2006年6月28日，王刚告诉张丽，为了前途，自己打算再次去阿联酋工作，但要缴纳一笔保证金，自己还差点钱。张丽当即给了他5000元。眼见从女网友处轻而易举地就弄来了5000块钱，王刚又有了新的主意。2006年7月初，王刚一面张罗着“出国”，一面通过手机短信告诉了张丽一个“秘密”：他在国外工作期间，被检查出患了艾滋病，现在需要一大笔钱来治疗。张丽再次相信了他的谎言，马上汇给了他一笔钱。此后的几个月，王刚又谎称感染的是特殊艾滋病，需要到青岛、北京等地的专业医院住院治疗，张丽一次又一次地将家里的存款汇给了王刚。
2007年1月24日，张丽丈夫发现家里的存款骤减，心生疑窦。经再三追问，张丽承认把钱借给一个朋友“治病”了。次日，张丽夫妇一起找到了王刚，在他们的一再催要下，王刚向张丽出具了一张15万元的借条。因王刚久拖不还，今年初张丽夫妇将其告上了法庭。庭审中被告人王刚辩称钱是借的，且钱已基本用于治疗艾滋病了。对于王刚是否患有艾滋病，疾控部门证实，中国疾病预防控制信息系统内没有王刚感染艾滋病的记录。王刚最终被诊断为尖锐湿疣。
法院审理查明，2006年7月至12月间，被告人王刚虚构染上艾滋病需要治疗的事实，向被害人张丽借钱，张丽先后10次通过银行向王刚银行卡内汇入人民币13.5万元。这些钱绝大部分被王刚在扬州取现或刷卡消费，而王刚也并未有任何出入境记录。今年4月28日，扬州市邗江区法院一审认为，被告人王刚虚构事实，骗取他人钱财，数额巨大，其行为已构成诈骗罪，且所骗赃款未退还，酌情应从重处罚。最终被告人王刚因犯诈骗罪被判处有期徒刑8年，并处罚金人民币10万元，其违法所得款继续予以追缴。 (张春萍 葛学涛 陈咏)
