法巴斯德研究所在艾滋病检测专利案中败诉

新华网巴黎１月２７日电（记者张之简）发现艾滋病病毒的法国巴斯德研究所日前在一场涉及艾滋病检测专利的官司中败诉，巴黎地方法院驳回其向美国一家实验室索取数百万欧元赔偿的诉求。
据法新社２６日报道，巴斯德研究所的科研人员在上世纪８０年代发现了艾滋病病毒，并与美国国家卫生研究所同时开发艾滋病病毒检测方法。为避免争端，双方签署协议达成专利交叉许可，允许在一定条件下把某些专利转让给第三方。此后，美国阿博特实验室获得美国国家卫生研究所的专利转让，开始使用巴斯德研究所的研究专利。
巴斯德研究所认为，阿博特实验室获得的专利不属于可转让部分，因此向巴黎地方法院控告阿博特实验室侵犯专利，索取７６０万欧元的赔偿。
据报道，巴黎地方法院日前驳回了这一诉求。法院认为，美国阿博特实验室“有权使用巴斯德研究所名下的欧洲专利”，判决巴斯德研究所向阿博特实验室支付１５万欧元的诉讼费用。
